1. Scope of license

COM3 IT Solutions grants each authorized end user a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the platform solely for the internal business purposes of the customer organization that provisioned the account.

The license covers the user interface, hosted application features, workflows, reports, dashboards, portal content, and related documentation made available through the platform, but it does not transfer ownership of any software, configuration logic, design assets, trademarks, or underlying intellectual property.

2. Account and authorized use restrictions

You may only use the platform through a valid account provisioned by COM3 IT Solutions or by an authorized customer administrator. Account sharing, credential resale, impersonation, or the creation of unauthorized secondary access paths is prohibited.

You may not copy, modify, reverse engineer, decompile, scrape, mirror, frame, benchmark for public comparison, or use the platform to build a competing service except to the extent a restriction cannot lawfully be limited under applicable law.

  • Do not attempt to bypass access controls, licensing controls, tenant boundaries, or audit mechanisms.
  • Do not upload unlawful, infringing, malicious, deceptive, or harmful content.
  • Do not use the platform to distribute malware, spam, destructive code, or unauthorized automated traffic.
  • Do not interfere with service stability, security testing boundaries, monitoring systems, or other users' access.

3. Customer data and user content

As between COM3 IT Solutions and the customer, customer records, files, tickets, configurations, documents, and other business data submitted to the platform remain the property of the customer or its licensors. You represent that you have the authority to submit the content you upload or manage through the platform.

You grant COM3 IT Solutions the limited rights necessary to host, process, transmit, secure, back up, display, and otherwise use customer data solely to operate, maintain, support, secure, and improve the platform and the contracted managed services.

4. Security and administrative controls

You are responsible for maintaining the confidentiality of your credentials, using reasonable endpoint security, and promptly notifying your administrator or COM3 IT Solutions if you suspect unauthorized access, compromise, or misuse.

COM3 IT Solutions may suspend, limit, or terminate access when reasonably necessary to protect the platform, investigate misuse, comply with law, enforce these terms, or respond to customer administrative instructions.

5. Updates, integrations, and third-party services

The platform may evolve over time. COM3 IT Solutions may add, modify, remove, or replace features, workflows, dependencies, security controls, or integrations when reasonably necessary for supportability, security, legal compliance, or service improvement.

Certain functionality may rely on third-party services or APIs. COM3 IT Solutions is not responsible for third-party terms, outages, data practices, or product changes outside its reasonable control, although it may help coordinate integration support where commercially appropriate.

6. Intellectual property

The platform, including its software, interface design, workflow architecture, source materials, text, graphics, processes, reports, and branding, is protected by intellectual property and other applicable laws. Except for the limited license expressly granted in this EULA, all rights are reserved by COM3 IT Solutions and its licensors.

7. Warranty disclaimer

To the maximum extent permitted by law, the platform is provided on an "as is" and "as available" basis. COM3 IT Solutions disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability, except to the extent a written master services agreement or statement of work expressly states otherwise.

8. Limitation of liability

To the maximum extent permitted by law, COM3 IT Solutions will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, or data, arising from or related to platform use. Where a separate written agreement governs liability between COM3 IT Solutions and the customer, that agreement controls to the extent it conflicts with this EULA.

9. Termination

This license remains in effect until terminated by COM3 IT Solutions, the customer organization, or by cessation of your authorized account status. Upon termination, your right to use the platform ends immediately, and you must stop using any platform materials except as otherwise allowed by the customer or applicable law.

10. Governing framework

This EULA is intended to operate together with the platform Terms and Conditions, Privacy Policy, and any controlling customer agreement between COM3 IT Solutions and the subscribing organization. If there is a conflict between this EULA and a separately executed customer agreement, the executed customer agreement governs to the extent of that conflict.
